These Terms of Use (“Terms”) govern your access to and use of the ISC Credit website at isccredit.com (“Site”) and the mortgage credit reporting services provided by Information Searching Company (“ISC,” “we,” “us,” or “our”). By accessing the Site or using ISC’s services, you agree to be bound by these Terms. If you do not agree, do not use the Site or ISC’s services.
These Terms apply to all visitors, clients, and authorized users. Use of ISC’s credit reporting services is also governed by your client agreement with ISC, which controls in the event of any conflict with these Terms.
ISC provides mortgage credit reports, supplements, rescores, borrower verifications, and related services exclusively to authorized mortgage lenders, brokers, and financial institutions (“Clients”). ISC does not provide credit reporting services directly to consumers. All services are provided for permissible purposes as defined under the Fair Credit Reporting Act (FCRA), 15 U.S.C. § 1681 et seq.
ISC’s services may only be used by authorized Clients for permissible purposes under FCRA. By using ISC’s services, you represent and warrant that:
Clients are responsible for maintaining the security and confidentiality of their ISC account credentials. You agree to notify ISC immediately at compliance@isccredit.com or 800-290-2801 if you suspect unauthorized access to your account. ISC is not liable for losses resulting from unauthorized use of your account credentials where you failed to maintain their security.
ISC works to provide accurate credit report data sourced from the major credit bureaus (Equifax, Experian, and TransUnion). However, ISC does not guarantee the accuracy, completeness, or timeliness of information contained in credit reports, as this information is provided by the credit bureaus and the creditors that report to them. ISC is not responsible for errors or omissions in bureau-sourced data.
Turnaround times stated on the ISC website are estimates based on typical performance. Actual turnaround times may vary based on documentation requirements, borrower authorization, bureau processing, and third-party availability. ISC does not guarantee specific turnaround times.
ISC Credit does not make lending decisions, approve or deny loan applications, or guarantee any particular credit score or loan outcome. All lending decisions are made by the Client lender or broker based on their own underwriting criteria and applicable regulatory requirements. ISC is not responsible for lending decisions made by Clients based on credit report information.
The site and ISC's services are provided “as is” and “as available” without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement. ISC does not warrant that the site will be uninterrupted, error-free, or free of viruses or other harmful components. Your use of the site and ISC's services is at your sole risk.
To the maximum extent permitted by applicable law, ISC and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising out of or in connection with your use of the site or ISC's services, even if ISC has been advised of the possibility of such damages. ISC's total liability to you for any claims arising from these terms or your use of ISC's services shall not exceed the fees paid by you to ISC in the twelve months preceding the claim.
Some jurisdictions do not allow the exclusion of certain warranties or limitations on liability, so some of the above limitations may not apply to you.
All content on the ISC website, including text, graphics, logos, and software, is the property of Information Searching Company or its licensors and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works from ISC website content without prior written permission.
The ISC website may contain links to third-party websites. ISC is not responsible for the content, accuracy, or privacy practices of third-party sites. Links do not constitute an endorsement by ISC of the linked site or its contents.
These Terms are governed by and construed in accordance with the laws of the State of California, without regard to conflict of law principles. Any dispute arising out of or relating to these Terms or ISC’s services shall be subject to the exclusive jurisdiction of the state and federal courts located in Orange County, California. You consent to personal jurisdiction in those courts.
ISC may update these Terms of Use from time to time. We will update the effective date at the top of this page when changes are made. Your continued use of the Site or ISC’s services after changes are posted constitutes your acceptance of the updated Terms. We encourage you to review these Terms periodically.
